These Terms of Service apply to purchases made through Millennium NYC and use of our website. By visiting our website, placing an order, creating an account, subscribing to updates, or interacting with our store, you agree to these Terms of Service and any other posted store policies, including our Shipping Policy, Returns & Refunds Policy, and Privacy Policy.
Please read these terms carefully before placing an order.
1. Our Store
Millennium NYC sells collectible products, trading card products, toys, accessories, display items, and related goods. Many of the items we sell are collectible, limited-release, condition-sensitive, market-sensitive, or subject to manufacturer and distributor availability.
Because of this, certain policies may differ from standard retail return expectations.
2. Agreement to Store Policies
By placing an order, you agree to the policies posted on our website at the time of purchase, including but not limited to:
- Terms of Service
- Returns & Refunds Policy
- Shipping Policy
- Privacy Policy
- Any product-specific terms listed on a product page
These policies are intended to be read together. If a product page contains specific terms, limitations, or final sale language, those product-specific terms also apply to that purchase.
3. Order Acceptance
Placing an order does not guarantee final acceptance of that order.
We reserve the right to cancel, limit, refuse, or modify an order when necessary, including but not limited to situations involving:
- Inventory discrepancies
- Pricing or listing errors
- Suspected fraud
- Payment issues
- Address or delivery concerns
- Distributor allocation reductions
- Manufacturer shortages
- Product availability changes
- Abuse of discounts, promotions, or purchase limits
- Automated purchasing activity
- Any other issue that affects our ability to fulfill the order properly
If we cancel all or part of an order, we will refund the unfulfilled portion of the order.
4. Product Availability
Product availability is not guaranteed until an order is fulfilled.
Some products, especially trading card products, pre-orders, limited releases, and high-demand collectibles, may be subject to allocation, delay, cancellation, or quantity adjustments.
We reserve the right to limit quantities per customer, household, address, account, payment method, or any other identifying information where needed to protect inventory integrity and fair access.
5. Pricing, Promotions & Listing Errors
We make reasonable efforts to keep pricing, product details, images, and availability accurate. However, errors may occur.
We reserve the right to cancel or correct orders affected by:
- Pricing errors
- Product detail errors
- Image errors
- Inventory errors
- Promotion or discount errors
- Technical issues
- Marketplace or platform syncing errors
Discount codes, promotional offers, and special pricing cannot be applied retroactively after an order has been placed.
Market price changes, restocks, sellouts, reprints, allocation changes, or changes in product demand do not qualify an order for cancellation, refund, exchange, or price adjustment.
6. Payments
Orders must be paid in full using an accepted payment method at checkout unless otherwise stated.
We may delay, cancel, or hold an order for additional review if a payment appears suspicious, incomplete, disputed, or otherwise flagged by our payment processor, fraud screening tools, or internal review.
We may request additional verification before fulfilling an order.
7. Cancellations
Order cancellation requests are not guaranteed.
Orders that have entered processing, packing, label creation, shipment preparation, or carrier handoff may not be eligible for cancellation.
Approved cancellations may be subject to cancellation or processing fees where stated in our Returns & Refunds Policy, product listing, or preorder terms.
8. Pre-Orders
Pre-order products are offered based on expected manufacturer, distributor, or supplier availability. Release dates and fulfillment timelines are estimates and may change.
Pre-orders may be affected by:
- Manufacturer delays
- Distributor delays
- Allocation reductions
- Product shortages
- Shipping delays
- Release date changes
- Market-wide supply issues
Allocation reductions, release delays, or changes in market value do not automatically qualify a preorder for cancellation, refund, exchange, or price adjustment.
If we cannot fulfill all or part of a preorder, we may cancel the unfulfilled portion and issue a refund for that portion.

9. Final Sale & Collectible Products
Certain products are final sale due to their collectible, limited-release, condition-sensitive, market-sensitive, sealed, blind, or chance-based nature.
Final sale items may include, but are not limited to:
- Trading card game products
- Sealed trading card products
- Booster packs, booster boxes, bundles, decks, tins, collection boxes, and similar products
- TCG singles
- Repacks or curated card packs
- Blind items
- Chase-based products
- Limited-release collectibles
- Special-order items
- Pre-orders
- Items marked “All Sales Final” on the product page

10. Product Images & Descriptions
Product images may include manufacturer-provided images, stock images, sample images, or photos of actual inventory.
Unless a listing specifically states that the exact item pictured is the item being sold, images should be treated as representative of the product.
Packaging, artwork, edition markings, assortment contents, case ratios, and manufacturer details may vary where applicable.
For collectibles, we make reasonable efforts to describe condition accurately. However, minor manufacturing, packaging, distribution, or shelf-wear imperfections may occur unless collector-grade condition is explicitly promised in the listing.
11. Manufacturer Defects & Packaging Variance
Manufacturer defects, factory collation issues, print errors, missing hits, packaging inconsistencies, or similar factory-level issues are generally handled by the manufacturer where applicable.
We do not guarantee the contents, pull rates, chase odds, card condition inside sealed products, factory collation, or manufacturer quality control unless explicitly stated.
For sealed products, minor outer packaging imperfections may occur, including but not limited to:
- Light corner wear
- Small dents or dings
- Minor shrink wrap flaws
- Surface scuffs
- Printing inconsistencies
- Loose wrapping
- Normal manufacturer or distributor handling marks
These issues do not automatically qualify an order for refund, exchange, or return unless otherwise required by law or unless the issue was caused by our handling.
12. Shipping & Delivery
Shipping, delivery, lost packages, delayed packages, refused packages, incorrect addresses, signature requirements, and carrier-related issues are governed by our Shipping Policy.
Customers are responsible for providing a complete and accurate shipping address at checkout.
We are not responsible for delays or delivery issues caused by incorrect addresses, incomplete addresses, carrier disruptions, weather, theft after delivery, failed delivery attempts, refusal of delivery, or failure to retrieve a held package.
If a package is returned to us due to an address issue, refusal, non-pickup, or failed delivery attempts, additional shipping, return postage, processing, or restocking fees may apply.
13. Account Conduct
You agree not to misuse our website, checkout system, promotions, inventory controls, or customer service channels.
Prohibited activity includes, but is not limited to:
- Fraudulent orders
- Payment abuse
- Chargeback abuse
- Use of bots, scripts, or automated checkout tools
- Circumventing purchase limits
- Creating multiple accounts to bypass restrictions
- Abuse of discounts or promotions
- Harassment, threats, or abusive communication
- Interference with website operation or security
We reserve the right to cancel orders, restrict accounts, refuse service, or block access where we believe these terms have been violated.
14. Fraud Prevention & Verification
To protect customers and inventory, we may review orders before fulfillment.
We may request identity verification, address confirmation, payment confirmation, or additional documentation before shipping an order.
Failure to complete requested verification may result in order cancellation.
We reserve the right to cancel, limit, or refuse orders suspected of fraud, resale abuse, automated purchasing, payment risk, or policy circumvention.
15. Chargebacks & Payment Disputes
If there is an issue with your order, please contact us first so we can try to resolve it directly.
In the event of a payment dispute or chargeback, we reserve the right to provide the payment processor, bank, platform, or relevant party with evidence related to the transaction, including but not limited to:

- Order records
- Tracking information
- Delivery confirmation

Abuse of chargebacks or payment disputes may result in refusal of future service.
16. Returns & Refunds
Returns, refunds, exchanges, cancellations, final sale items, restocking fees, damaged items, incorrect items, and preorder cancellations are governed by our Returns & Refunds Policy.
We reserve the right to deny returns or refunds for items that are opened, altered, resealed, used, damaged, tampered with, returned without authorization, or returned in a different condition than shipped.
17. Intellectual Property
All website content, including text, graphics, logos, branding, product descriptions, original photography, design elements, and other store-created materials, belongs to Millennium NYC or its respective rights holders.
You may not copy, reproduce, scrape, redistribute, modify, or use our content for commercial purposes without permission.
Manufacturer names, product names, brand names, logos, and trademarks belong to their respective owners and are used for identification and product description purposes only.
18. Third-Party Services
Our store may use third-party services, including payment processors, shipping carriers, fraud prevention tools, analytics providers, email providers, marketplace integrations, and Shopify-related services.
We are not responsible for service interruptions, errors, delays, or failures caused by third-party platforms or providers.
Use of third-party services may also be subject to those providers’ own terms and policies.
19. Limitation of Liability
To the fullest extent permitted by law, Millennium NYC shall not be liable for indirect, incidental, special, consequential, punitive, or speculative damages arising from use of our website, purchase of products, delayed fulfillment, unavailable inventory, carrier issues, product value changes, or inability to complete an order.
Our total liability for any order shall not exceed the amount paid for the affected item or order, excluding amounts not recoverable under our posted policies.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply where prohibited by law.
20. Force Majeure
We are not responsible for delays, cancellations, partial fulfillment, or inability to perform due to events outside our reasonable control.
These may include, but are not limited to:
- Natural disasters
- Severe weather
- Government actions
- Carrier disruptions
- Labor disputes
- Supply chain issues
- Manufacturer shortages
- Distributor allocation reductions
- Payment processor holds
- Fraud prevention reviews
- Platform outages
- Technical failures
- Public emergencies
- Other events beyond our reasonable control
In these situations, we may delay fulfillment, partially fulfill, cancel, refund, or modify orders as reasonably necessary.
21. Refusal of Service
We reserve the right to refuse service to any customer where permitted by law.
This may include cases involving fraud, abuse, threats, harassment, chargeback abuse, policy circumvention, automated purchasing, or conduct that interferes with our ability to operate fairly and safely.
